Order
1. It is brought to our notice that Commissioner of Police, Economic Offences Wing requires Report of the Forensic Auditors. We permit the Forensic Auditors to furnish the Report to the Economic Offences Wing but they shall not be summoned for any purpose whatsoever to aid in the investigation.
2. A notice issued by the DRT has been brought to our notice, it appears that Tower Nos. II, IV and V are to be visited by the prospective buyers. On 26.04.2019, the buyers have inspected the said towers. Because the record is placed in the tower, it is offered by the Forensic Auditors that the inspection by prospective buyers may be done on a date fixed by DRT. The DRT is requested not to assume that “Forensic Auditors are hampering the auction proceedings”. They are rather assisting this Court in the entire process and we appreciate the able assistance rendered by them.
3. We have directed learned counsel appearing on behalf of M/s. Jotindra Steel and Tubes Ltd., and M/s. Mauria Udyog Ltd. to file affidavit on behalf of Mr. Akhil Sureka, Managing Director, M/s. Jotindra Steel and Tubes Ltd., and Mr. Navneet Sureka, Managing Director, M/s. Mauria Udyog Ltd.
4. We have heard arguments of Forensic Auditors on their Report. We have also heard Mr. Krishnan Venugopal, learned senior counsel and Mr. M.L. Lahoty, learned counsel. Arguments remained inconclusive.
5. List tomorrow i.e. on 01.05.2019.
