MISC. APPLN. NOS 696-722 OF 2018 IN CIVIL APPEAL NOS. 2368 OF 2011, 2369 OF 2011, 2370-2373 OF 2011, 2364-2377 OF 2011, 2378 OF 2011, 2379 OF 2011, 4320-4327 OF 2011 AND 5280-5286 OF 2011:
1. The applications are taken on Board.
2. We have heard Sh. Mukul Rohtagi, learned senior counsel appearing for the State of Karnataka On the issue of implementation of judgment of this Court in B.K. Pavitra v. Union of India (2017) 4 SCC 620.
3. We do not find any ground to extend the time for implementation of the judgment on the ground of pendency of matters before a large Bench or on the ground of pendency of a proposed legislation since the judgment has attained finality.
4. Our attention has been invited to orders dated 22nd January, 2018 and 19th February, 2018 in Special Leave Petition (Civil) Nos. 642-661 of 2018 (R.T. Chandramouli v. The State of Karnataka) and Special Leave Petition(Civil)D. No. 4001 of 2018 (L. Shashikumar v. State of Karnataka) of this Court wherein order of status quo has been passed. However, thereafter the very same Bench in another matter arising out of the same issue, passed the following order on 12th March, 2018 in Special Leave Petition (Civil) No. 7201 of 2018 (Chandranna A. v. State of Karnataka).
“These matters are connected with the case of B.K. Pavithra v. Union of India [(2017) 4 SCC 620. It will be appropriate if these matters along with other connected matters are listed before the same Bench [Hon’ble Mr. Justice Adarsh Kumar Goel and Hon’ble Mr. Justice Uday Umesh Lalit]”
5. Accordingly, applications of the State of Karnataka for extension of time are dismissed.
6. Sh. Mukul Rohtagi, learned senior counsel fairly stated that seniority list has already been revised in compliance of judgment of this Court. Only consequential action remains to be taken. Let the same be taken within one month from today.
7. In case the judgment is not complied within one month, the Chief Secretary of the State of Karnataka may remain present in this Court on 25th April, 2018.
