Order

1. Heard learned counsel for the parties.

2. This court vide order dated 12-10-20181 directed as under:

“Heard learned counsel for the parties.

Application for impleadment is allowed, if not already done.

The petitioners and the impleaded parties are provisionally permitted to participate in the examination for selection and appointment to the post of Assistant Professor (Education) in the normal degree colleges pursuant to Advertisement No. 47. However, their results shall not be declared. The same shall be made available in a sealed cover to this Court as and when the same is ready.

We make it clear that this order is confined only to those petitioners and intervenors/impleadors, who are before us as on today. We are informed that all the petitioners and intervenors/impleadors herein have submitted their application before the cut off date, namely, 14.07.2017.”

3. The other relevant order to be reckoned is dated 2-11-20182. It clarifies the position that the cut-off date noted in the previous order be read as 14.07.2016 instead of 14.07.2017.

4. Besides the said order, there is another interim order passed on 26-11-20183 which reads as under:

“The cut off date referred to in the order dated 12-10-20181 will stand clarified as the cut off date finally fixed by the Competent Authority for the submission of the applications.

Issue notice in all the pending applications, returnable on 10.12.2018.

5. In terms of this order, the cut-off date will have to be reckoned as 05.08.2016 being finally fixed date by the Competent Authority.

6. In terms of the above orders, we direct the respondents to process all the applications received on or before 05.08.2016 by it and proceed with the selection process in accordance with law.

7. The selection process, however, will be subject to the outcome of this Special Leave Petition. In case, the management rejects the application of any candidate being not in conformity with the eligibility condition, the said candidate may have to take recourse to other remedy and that grievance cannot be and will not be made subject matter of this Special Leave Petition.

8. We reiterate the direction given in order dated 12-10-20183 that the results shall not be declared and the same shall be made available in sealed cover to this Court as and when the same is ready.

9. List the matter on 23.01.2019.
