(Ranjan Gogoi, R. Banumathi and Navin Sinha, JJ.)
Adv. C.K. Mohanan _______________________________ Appellant
v.
High Court of Kerala _____________________________ Respondent
Criminal Appeal No(s). 108/2017, decided on July 9, 2018
With
Criminal Miscellaneous Petition No. 992/2017
The Order of the court was delivered by
ORDER
1. Heard learned counsels for the parties and perused the relevant material.
2. Though limited notice was issued by this Court, on unconditional apology being tendered by the alleged contemnor, this Court by order dated 25.01.2018 had directed that a similar affidavit be filed before the High Court and the High Court would be free to pass appropriate orders thereon.
3. Thereafter, it appears that an affidavit expressing unconditional regret has been filed by the alleged contemnor before the High Court. The High Court by order dated 27.06.2018 has accepted the unconditional apology and has passed orders closing the matter(s).
4. In view of the above developments, we are of the view that the contempt proceedings in question should be appropriately brought to an end. The said proceedings shall, accordingly, stand closed. The sentence of imprisonment awarded against the contemnor is consequently set aside. The fine amount which has since been paid be returned to the alleged contemnor.
5. Criminal appeal as well as all pending application(s) shall stand disposed of in the above terms.
